These Terms and Conditions ("Terms") apply to the Platterify website, web application, and multiplayer hospitality services (collectively, the "Application"), developed by Franciszek Czajka under the name Lapwing Software ("Service Provider", "we", "us", or "our"). By accessing, using, or participating in table sessions within the Application, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Application. These Terms do not limit any mandatory consumer rights that cannot be waived under applicable law.

Definitions

  • Application: the Platterify website, web application, table session interfaces, kitchen display system (KDS) panels, menu management portals, backend services, database operations, and related support tools.
  • Restaurant User: any business, restaurant owner, manager, operator, or waitstaff who registers an account, configures menus/floor plans, or manages orders through the Application.
  • Dining Guest: any individual who accesses the Application (e.g., by scanning a QR code at a physical dining table) to view menus, join multiplayer sessions, submit orders, claim order items, tip, or settle checks.
  • User: any Restaurant User, Dining Guest, or visitor accessing the Application.
  • User Content: menus, category names, floor plan layouts, items, pricing, tax configurations, guest display names/aliases, feedback, or other data you submit, store, or manage in the Application.

Eligibility and Age Requirements

Platterify is intended to be used by adults. Account creation, configuring table settings, and paying dining checks should be performed by individuals who are at least 18 years of age or under the supervision of a parent or guardian. If you allow a minor to use the Application, you are responsible for their conduct and compliance.

License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Application. Restaurant Users receive a license to manage their hospitality venues, and Dining Guests receive a license to participate in table sessions and process transactions.

You may not copy, modify, reverse engineer, decompile, disassemble, translate, create derivative works from, bypass protections in, sell, rent, sublicense, distribute, or otherwise exploit the Application except where expressly permitted by applicable law.

The Application, brand, logo, interface design, source code, artwork, and databases are owned by the Service Provider or its licensors and are protected by intellectual property laws. All rights not expressly granted are reserved.

User Content and Ownership

You are responsible for User Content you submit or manage through the Application. You must have all rights and permissions needed to submit that content and to allow us and our service providers to process it for the purposes of operating the Application.

As between you and the Service Provider, you retain any rights you have in your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and use your User Content as needed to provide, secure, maintain, and improve the Application.

Feedback, suggestions, and ideas you send to us may be used without compensation to you.

Accounts and Security

Some features (such as configuring menus and tracking dashboard analytics) require a restaurant manager account. You are responsible for providing accurate account information, keeping your credentials secure, maintaining control of your device, and all activity that occurs through your account.

Authentication is handled securely through Supabase. We strongly recommend against bypassing device security controls (such as jailbreaking or rooting) as doing so may expose data or cause the Application to malfunction.

Acceptable Use

You agree not to:

  • use the Application for unlawful, fraudulent, harmful, or abusive purposes;
  • submit content that infringes another person's rights or violates applicable law;
  • submit sexual, exploitative, hateful, harassing, threatening, or violent content;
  • submit malware, malicious code, or other harmful material;
  • attempt to bypass payment validation, rate limits, authentication, or security protections;
  • attempt unauthorized access to accounts, tables, sessions, databases, functions, or data related to the Application;
  • interfere with or disrupt the security, integrity, availability, or performance of the Application;
  • use automated means to scrape, harvest, overload, or extract data except where allowed by law;
  • misrepresent your identity or create accounts for abusive purposes.

Feature Limits and Fair Use

We may apply limits to protect the Application, prevent abuse, and keep service quality reliable. These include rate limits on guest join PIN entries and endpoint abuse controls.

Table sessions and application features do not guarantee permanent availability of every feature or data record. We may block, throttle, suspend, or refuse requests that violate these Terms, exceed limits, create security risks, or appear abusive.

Third-Party Services and Terms

The Application uses third-party services that are governed by their own terms and policies. Your use of those services may be subject to the applicable third-party terms.

Connectivity and Availability

The Application requires an active internet connection to join table sessions, view menus, submit orders, check out, and sync state in real time. You are responsible for internet access, mobile data charges, roaming charges, device compatibility, and operating system support.

We may modify, suspend, limit, replace, or discontinue any part of the Application at any time, including to improve functionality, maintain security, manage costs, comply with law, or respond to third-party service changes.

Payments and Transactions

Restaurant Payouts: Payouts for table check transactions are handled via Stripe Connect, and Restaurant Users agree to be bound by the Stripe Connected Account Agreement.

Dining Transactions & Settlement: Guests pay checks, tips, and service fees through Stripe checkout. Stripe handles all card processing and billing details. All charges are executed upon guest payment submission during table checkout or split settlement.

Refunds: All payments and billing are governed by the respective Stripe terms and policies. Refund requests must be handled in accordance with the restaurant's policy and/or processed through the restaurant's merchant tools.

Account Deletion and Termination

You may request account deletion through the Application or by contacting the Service Provider. Account deletion removes your account and user-owned server records linked to that account, subject to retention described in the Privacy Policy.

We may suspend, restrict, or terminate access to the Application or any account if we reasonably believe that you violated these Terms, created risk or harm, failed payment validation, or if we must do so to comply with law or third-party provider requirements.

No Warranty

The Application is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, we disclaim warranties of merchantability, fitness for a particular purpose, accuracy, availability, quiet enjoyment, and non-infringement. We do not guarantee that the Application will be uninterrupted, error-free, secure, compatible with every device, or that orders will always be transmitted without delay.

Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, device functionality, or service availability arising from or related to your use of the Application.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Application after changes become effective means you accept the updated Terms.
